CUSTODY & VISITATION
Custody and visitation are issues that accompany divorce proceedings involving children, Suits Affecting the Parent-Child Relationship (SAPCRs), and Suits to Adjudicate Parentage (Paternity Suits). Typically, the parties can agree on terms controlling custody and visitation. If not, the court will decide after a trial on the merits.
The Texas Standard Possession Order ("SPO") is presumed to be the best custody and visitation arrangement unless proven otherwise. Generally, the Texas SPO names both parents Joint Managing Conservators ("JMC") but grants only one of the parents the exclusive right to determine the child or children's' residence (this is the parent typically referred to as having "custody"; the other parent therefore has "visitation"). The SPO gives The JMC with visitation possession of and access to the child or children on the first third and fifth weekends of every month, as well as Wednesday evenings during off-weeks. Most holidays alternate between the JMCs. The JMC awarded custody has possession of the child or children at all other times.
